Alerting regulatory and professional bodies to lawyer misconduct has traditionally been a predominantly reactionary process, heavily reliant upon client complaint. It cannot be assumed, however, that client complaint will unearth all forms of lawyer misconduct. Accordingly, there is a legitimate question over whether lawyers should, as members of a profession, perform a self-policing function in reporting their peers' misconduct to the relevant body. The point assumes especial significance in the Australian context because Australia is unique, vis-à-vis comparable common law jurisdictions, (...) in not imposing any general professional obligation to report. Before being considered as independent fields, business cycles and productivity growth had long been regarded as closely interrelated dynamics. Growth and cycles theories and models developed independently. On one side, the growth analysis developed analyzing the existence and stability of a long-run deterministic growth path. On the other side, business cycles theory focused on the understanding of detrended data movements considering growth as an exogenous trend, independent of the cycle. This dichotomy is still present in the modern literature. _Business Cycles (...) and Growth Theory_ examines the role of monetary and financial factors in growth cycles dynamics interaction. It offers new perspectives for modelling growth cycles dynamics underlining the possibility of building an 'incomplete business cycles theory', as well as highlighting the existence of a convergence between the last theoretical developments of both growth and business cycles literatures. A significant read, this book demonstrates that such a convergence can provide benchmarks for a new paradigm of models in which endogenous growth mechanism, because it offers a strong propagation for shocks, can be the core of a new business cycles dynamics. The paper presents different clustering approaches in legal judgments from the Special Civil Court located at the Federal University of Santa Catarina. The subject is Consumer Law, specifically cases in which consumers claim moral and material compensation from airlines for service failures. To identify patterns from the dataset, we apply four types of clustering algorithms: Hierarchical and Lingo, K-means and Affinity Propagation. We evaluate the results based on the following criteria: entropy and purity; algorithm's ability in providing labels; legal expert’s (...) evaluation; and experimental complexity. The results demonstrate that the most advantageous approach is Hierarchical Clustering, since it has the best entropy and purity numbers, as well as the least difficulty for the expert to analyze the clusters, and the least experimental complexity. The main contribution of the paper is to show the advantages and disadvantages of each approach, especially to identify labels in unstructured and non-indexed legal texts. (shrink)

Background: Undergraduate nursing students have been documented to experience ethical distress during their clinical training and felt poorly supported in discussing the ethical issues they encountered. Research aims: This study was aimed at exploring nursing students’ perceived opportunity to discuss ethical issues that emerged during their clinical learning experience and associated factors. Research design: An Italian national cross-sectional study design was performed in 2015–2016. Participants were invited to answer a questionnaire composed of four sections regarding: socio-demographic data, previous clinical learning (...) experiences, current clinical learning experience quality and outcomes, and the opportunity to discuss ethical issues with nurses in the last clinical learning experience. Participants and research context: Participants were 9607 undergraduate nursing students who were attending 95 different three-year Italian baccalaureate nursing programmes, located at 27 universities in 15 Italian regions. Ethical considerations: This study was conducted in accordance with the Human Subject Research Ethics Committee guidelines after the research protocol was approved by an ethics committee. Findings: Overall, 4707 perceived to have discussed ethical issues ‘much’ or ‘very much’; among the remaining, 3683 and 1217 students reported the perception of having discussed, respectively, ‘enough’ or ‘never’ ethical issues emerged in the clinical practice. At the multivariate logistic regression analysis explaining 38.1% of the overall variance, the factors promoting ethical discussion were mainly set at the clinical learning environment levels. In contrast, being male was associated with a perception of less opportunity to discuss ethical issues. Conclusion: Nursing faculties should assess the clinical environment prerequisites of the settings as a context of student experience before deciding on their accreditation. Moreover, the nursing faculty and nurse managers should also enhance competence with regard to discussing ethical issues with students among clinical nurses by identifying factors that hinder this learning opportunity in daily practice. In this paper, we focus on some misconceptions about Critical Pragmatics, what it is, what it assumes and what it proposes. Doubtless, some of these misconceptions are due to clumsy writing on our part; perhaps others are due to inattentive reading. And some may be due to an effort to shield us from the apparent implausibility of what we said—and in fact meant. It does not matter much. We focus on those misunderstandings that most matter to us, either because, by (...) repetition, they have ended up being annoying, even if they are not, perhaps, that important; or because they are substantial enough to represent a distortion of the basic picture of Critical Pragmatics and its theoretical foundations, namely, Critical Referentialism—also known as the Reflexive-referential Theory—and, more generally, Perry’s fundamental views on meaning and content(s). The physician of fifty years ago is barely recognizable today. Rural, autonomous, and isolated, he did everything from mending broken bones to pronouncing people dead. He was responsible for a well-circumscribed community, who came to him for all their medical needs, regardless of the hour.

Singular terms without referents are called empty or vacuous terms. But not all of them are equally empty. In particular, not all proper names that fail to name an existing object fail in the same way: although they are all empty, they are not all equally vacuous. “Vulcan,” “Jacob Horn,” “Odysseus,” and “Sherlock Holmes,” for instance, are all empty. They have no referents. But they are not entirely vacuous or useless. Sometimes they are used in statements that are true or (...) false. We are basically referentialists about proper names. The ordinary semantic function of a proper name is to refer to an object, and to do it directly, that is, without semantically providing any identifying condition that the object should meet to be the referent. To put it differently, we agree that statements containing proper names express singular propositions, i.e., that their truth-conditions involve the referent of the proper name, if it exists, and not any identifying condition of it. Now, since empty names lack a referent, and therefore would not express such a singular proposition, how do we explain that many, if not all, statements containing them have a truth-value? Answering this question for the case of fictional names, in particular, is the aim of this paper. (shrink)

Ao longo da história, as mulheres foram colocadas à margem dos direitos sociais. Apesar disto, foram responsáveis por inúmeras contribuições nos saberes de modo geral. Como afirma Costa e Silva (2000, p. 8): “Não obstante o impacto visível de algumas modificações concretas, a maioria das pessoas, incluindo aí homens e mulheres, mesmo entre setores mais instruídos, continuam a pensar de acordo com esquemas patriarcais antigos”. A partir desta reflexão surge um questionamento: Por que, no ensino médio, se estudam pouquíssimas mulheres (...) filósofas e cientistas? O presente projeto objetiva fomentar a discussão acerca das contribuições de mulheres no âmbito da Filosofia e Ciência, construindo e fortalecendo a autonomia, a emancipação e o empoderamento feminino das alunas do ensino médio. O projeto foi executado na EEEP Guilherme Teles Gouveia em 2022. Estudantes e o professor de filosofia pesquisaram sobre mulheres que contribuíram para a humanidade. A partir das discussões e pesquisas foram elaborados questionários e um evento denominado “Simpósio: mulheres na Ciência e na Filosofia”, que levou alunos e alunas ao conhecimento sobre filósofas e cientistas de todas as épocas. Os resultados foram constatados através dos relatos do público e das participantes, no qual foram avaliados os impactos da ação para a comunidade escolar. (shrink)

OBJECTIVES: To review the characteristics and performance of research ethics committees in Spain in the evaluation of multicentre clinical trial drug protocols. DESIGN: A prospective study of 100 applications. SETTING: Forty-one committees reviewing clinical trial protocols, involving 50 hospitals in 25 cities. MAIN MEASURES: Protocol-related features, characteristics of research ethics committees and evaluation dynamics. RESULTS: The 100 applications involved 15 protocols (of which 12 were multinational) with 12 drugs. Committees met monthly (except one). They had a mean number of 12 (...) members, requested a mean of six complete dossiers and nine additional copies of the protocol with a mean deadline of 14 days before the meeting. All applications were approved except three (two of the three were open-label long-term safety trials rejected by the same committee), which were approved by the other committees involved. The mean time from submission to approval was 64 days. The mean time from submission to arrival of the approval document at our offices was 85 days. Twenty-five committees raised queries for 38 of the 97 finally approved applications. Impact of evaluation fee, number of members, queries raised and experience of committees on timings were not statistically significant. CONCLUSION: Obtaining ethical approval is time-consuming. There is much diversity in the research ethics committees' performance. A remarkable delay (> 20 days) exists between the decision and the arrival of the written approval, suggesting administrative or organisational problems. (shrink)

The authors undertake a thought experiment the purpose of which is to explore possibilities for understanding moral principles in analogy with cosmic order. The experiment is based on three proposals, which are described in detail: an ontological, a neurological, and a moral proposal. The ontological proposal accepts from the phenomena of quantum physics that there is a nonempirical domain of physical reality that consists not of material things but of what is philosophically conceptualized as a realm of nonmaterial forms. This (...) realm of forms is the realm of potentiality in physical reality that quantum physics posits as an indivisible Wholeness—the One. It is the ultimate reality because everything empirical is the actualization of its forms. The neurological proposal is the hypothesis that the brain is sensitive to the potentiality waves in the cosmic field, as ordinary measuring instruments in physics are sensitive to potentiality waves at the quantum level, so that the cosmic field can communicate with the human brain. The third proposal assumes that the communication with the cosmic field can translate into moral ideas and actions. Even though the three proposals underlying the thought experiment are highly speculative, they lead to definite implications that make sense in their own right and can be applied in a useful way. From the order of reality some simple rules of conduct follow that are identical with traditional moral rules but have the character of rules of well-ness, leading to new aspects of Aristotle's concept of eudaimonia and Kant's concept of the highest good. In analogy with the structure of physical reality, where all empirical phenomena are actualizations of nonempirical forms, it is suggested that the structure of morality, too, is that of a tacit, nonempirical form that actualizes in explicit principles and moral acts through our consciousness. The tacit form is thought to exist in the realm of cosmic potentiality, together with all the other forms that the empirical world actualizes. It can appear spontaneously in our consciousness when needed, offering its guidance to our judgment and free will. Because it does not appear in the form of commandments accompanied by threats, the actions of the tacit moral form define a higher level of morality, similar to that offered by some aspects of the Christian teaching, where one acts not out of fear but on the desire to do things right. En associant philosophie et logique, cet ouvrage apporte un éclairage sur l'évolution de la logique de l'époque d'Aristote à nos jours. Il présente les différents formalismes des logiques non-standard en expliquant tout d'abord les besoins de ces logiques puis leurs descriptions syntaxiques et sémantiques. A l'aide d'exercices, il offre un panorama de ces logiques qui sont complexes à " utiliser " pour modéliser des connaissances permettant ainsi aux lecteurs d'appréhender ce domaine.

Denommer, c'est appeler les etres et les choses par le nom qui leur a ete institue dans et par la langue. Assurant l'intercomprehension entre les locuteurs, la denomination constitue une propriete fondamentale du lexique et des terminologies. Si epistemologiquement, la denomination fait partie integrante des appareils conceptuel et methodologique de la Linguistique et de la Terminologie, dans l'une et l'autre discipline elle connait une situation paradoxale. D'une part elle souffre d'un deficit important de conceptualisation; de l'autre elle se revele etre (...) un puissant moteur pour la description semantique et referentielle du lexique et des terminologies. L'objet du present ouvrage est de proposer un reexamen systematique et explicite de cette notion et de lui assurer un positionnement valide dans l'appareil theorique de la Linguistique. Refusant une caracterisation monolithique, l'analyse opte pour une conception modulaire, articulee sur les differents parametres combinables et superposables qui definissent cette propriete: ontologiques, sociolinguistiques, juridiques et linguistiques. L'objectif de ce travail est egalement heuristique: envisager la denomination comme un levier en vue du reexamen du concept de polysemie, qui lui est consubstantiellement lie. Appliquee aux modeles categoriels et non categoriels, la denomination permet de distinguer entre emplois relevant effectivement d'une polysemie lexicale de ceux procedant d'effet impartis aux instanciations de vocables. Objectives: To review the performance of research ethics committees in Spain in assessing multicentre clinical trial drug protocols, and to evaluate if they would comply with the requirements of the new EU Directive to be implemented by May 2004.Design and setting: Prospective study of applications of MCT submitted to RECs.Main measurements: Protocol related features and evaluation process dynamics.Results: 187 applications to be performed in 114 centres, were reviewed by 62 RECs. RECs had a median number of 14 members, of which (...) three were lay members. All applications were approved except four which were however approved by the other RECs involved. The median times from submission to approval and from submission to reception at the sponsor’s offices were 48 and 62 days, respectively. In 55% of all applications approved, 41 RECs raised 307 queries, 40% of these were protocol related issues, and 38% related to the patients’ information sheets. RECs charging an evaluation fee in advance and applications with no queries raised were statistically significantly associated with shorter evaluation times. However, there is a gap of at least 1.5 weeks between the date of the meeting and the reception of the approval letter in the sponsor’s office.Conclusions: Evaluating MCT protocols by RECs is a time consuming process. Needing 1.5 weeks for communicating the decision taken by RECs to the sponsor suggests serious administrative shortcomings within most RECs. By significantly reducing the time for communication of their decisions, the majority of RECs would comply with the Directive requirement of a maximum 60 day period for the assessment of MCT. Para tanto, o autor aponta que há uma transformação nas relações sociais (...) de massa, dado que o ser humano está em uma situação de contestação própria individualismo, além de conectado na era da tecnologia, uma condição sobreposta, devido ao acesso aos meios digitais e à revolução das relações sociais ocasionadas também pelos meios tecnológicos, gerando um fenômeno aparentemente contraditório: a distância mental entre os indivíduos.Nestes espaços públicos virtuais em que nos relacionamos, mesmo diante da possibilidade de controle do comportamento social, que se dirige tanto ao âmbito privado quanto ao público e que, por isto mesmo, percebe-se a necessidade de incluirmos neste afã de comunicação a precaução, segundo a suposição de que seria possível deter a constituição de ideologias de massa em desconformidade com a manutenção da vida, da harmonia social e da democracia, devido à percepção de que, nas tomadas de decisão, interesses perniciosos poderiam também se insinuar. Neste particular, Han esclarece que não somos mais apenas destinatários e consumidores passivos de informação, mas sim remetentes e produtores ativos, de modo que não nos contentamos apenas consumir como também passamos a produzir informação.O livro foi organizado em um prefácio, seguido de dezesseis seções, nas quais os assuntos abordados se relacionam entre si, contudo, independentes em suas próprias abordagens. Nesta resenha foram analisadas todas as seções e, dessa maneira, serão apresentadas conforme se dispõe na obra “No Enxame: Perspectiva do Digital”. E, no que diz respeito ao prefácio, recomenda-se a leitura, por fornecer esclarecimento prévio ao leitor. Por fim, o livro é recomendável para todos os entusiastas do campo da mídia digital e, principalmente, dos assuntos relacionados a uma sociedade de massas que se fora em paralelo com as tecnologias digitais. This paper presents an approach to the belief system based on a computational framework in three levels: first, the logic level with the definition of binary local rules, second, the arithmetic level with the definition of recursive functions and finally the behavioural level with the definition of a recursive construction pattern. Social communication is achieved when different beliefs are expressed, modified, propagated and shared through social nets. This approach is useful to mimic the belief system because the defined functions provide (...) different ways to process the same incoming information as well as a means to propagate it. Our model also provides a means to cross different beliefs so, any incoming information can be processed many times by the same or different functions as it occurs is social nets. (shrink)

This paper considers one of the most significant and controversial attempts to account for the meaning of pejoratives as lexical items, namely Hom and May’s. After outlining the theory, we pinpoint sets of pejorative sentences that come out true on their account and for which the question as to whether they are compatible with the view advocated by them (so-called Moral and Semantic Innocence) remains open. Helping ourselves to the standard model-theoretical framework Hom and May (presumably) work in, we prove (...) they are compatible with the view. Given that the issues of both the moral import of pejoratives and the practical effects of their utterance are not settled by the proof, we then highlight unwelcome moral and pragmatic implications for some of the pejorative sentences under scrutiny, thereby showing that the view, broadly understood, is not as morally and semantically innocuous as it is meant to be. Auguste Comte et William Whewell sont contemporains. Tous les deux ont écrit sur de nombreux sujets : histoire et philosophie des sciences, astronomie, mécanique, philosophie morale et réflexions sur l’éducation. Leurs œuvres de philosophie des sciences sont parmi les plus importantes du XIXe siècle. Mais si celle du premier a marqué le siècle, celle du second n’a fait que de timides apparitions. C’est probablement par John Stuart Mill, à la fois disciple et sectateur de Comte et farouche opposant de Whewell, (...) que les deux philosophes ont connu chacun l’œuvre de l’autre. Leurs œuvres présentent des ressemblances dans la démarche et dans la méthode mais elles s’opposent sur de nombreuses questions de fond. On cherche à montrer la grandeur du philosophe britannique à qui l’histoire n’a pas fait la place que l’immensité de son œuvre aurait dû lui valoir.Auguste Comte and William Whewell are contemporaries. Both wrote on numerous topics : i.e. history, philosophy of sciences astronomy, mechanics, moral philosophy and thoughts on education. Their works are among the most important ones of the 19th century. But whereas those of the former left their mark on the century, those of the latter were but rather shyly prominent. It is most probably through John Stuart Mill, both a disciple and worshipper of Comte’s whilst a fierce opponent of Whewell’s that both philosophers both came across each other’s works. Both their works are similar in the methodological approach but they differ greatly on fundamental topics. One aims at showing the greatness of the British philosopher to whom history never gave the reputation he should have been granted by his works. (shrink)

Adapting the EU Kids Online questionnaire, a sample of 279 participants in an intervention program on digital inclusion was interviewed in order to analyze their online experiences, bearing in mind the EU Kids Online results and the wider debate on digital inclusion. This issue was examined at two levels: access, and practices and uses. Although economic deprivation, parents’ low educational (...) attainment and children’s age and gender seem to matter in terms of access, reported uses were analogous to the average Portuguese and EU Kids Online data. However, with these children apparently being more oriented towards entertainment and having less informational skills, it is questionable if policies that merely assure access are entirely sufficient. Nevertheless, one cannot say straightforwardly that ‘social exclusion’ equates ‘digital exclusion’. (shrink)
